TopCar Terms of Use

Welcome to TopCar, owned and operated by TopCar Media LLC ("Company," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the TopCar mobile application, website located at top.car, and related services (collectively, the "Services"). Please read them carefully.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement.
2. Account Registration
You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information and to keep this information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. User Content
Your Ownership
You retain ownership of all content you create and upload to TopCar, including but not limited to:
- photographs
- videos
- vehicle information
- build information
- garage information
- event submissions
- comments
- reviews
- profile information
- and any other content you submit through the Services ("User Content").
Submitting User Content to TopCar does not transfer ownership to us. You remain free to use, license, or monetize your content elsewhere.
License You Grant to TopCar
By uploading User Content, you grant TopCar a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publicly perform, distribute, and otherwise use your User Content solely for operating, improving, promoting, and providing the Services.
Modifications
TopCar may make limited modifications to User Content as reasonably necessary for technical or operational purposes, including formatting, compression, resizing, cropping, thumbnail generation, transcoding, or adapting content for different devices or platforms.
TopCar will not materially alter the creative substance of your content without your consent.
Attribution
Whenever reasonably practical, TopCar will credit you as the creator when your User Content is used in connection with the Services or promotional materials.
Your Responsibilities
You represent and warrant that:
- you own or have all necessary rights to upload your User Content;
- your User Content does not infringe upon the rights of any third party;
- any information you submit regarding a vehicle is accurate to the best of your knowledge.
4. Vehicle Information and Verification
TopCar may offer features relating to vehicle verification, builder verification, ownership verification, vehicle histories, digital records, badges, Car Passports, registries, or similar services.
Unless expressly stated otherwise, these features are provided for informational and community purposes only and do not constitute legal proof of ownership, title, authenticity, provenance, valuation, or condition of any vehicle.
Users remain solely responsible for verifying ownership, title, and any other legal rights relating to vehicles.
5. Competitions and Voting
TopCar may offer competitions, rankings, community voting, awards, and similar features.
Unless otherwise stated, competition results reflect activity within the TopCar platform and should not be interpreted as objective statements regarding the quality, value, authenticity, or condition of any vehicle.
We reserve the right to modify, suspend, or cancel competitions or remove fraudulent votes or submissions at our sole discretion.
6. Prohibited Conduct
You agree not to:
- use the Services for any unlawful purpose;
- infringe the intellectual property or other rights of others;
- upload false or misleading information;
- impersonate another person or falsely claim ownership of a vehicle;
- interfere with or disrupt the Services;
- attempt unauthorized access to accounts or systems;
- upload malware or harmful code;
- use bots or automated systems to manipulate competitions, rankings, or voting.
7. Intellectual Property
The Services and all related software, graphics, logos, trademarks, text, and content (excluding User Content) are owned by TopCar Media LLC or its licensors and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, or create derivative works without prior written permission.
8. Third-Party Services
The Services may include links to third-party websites, products, or services. We are not responsible for their content, privacy practices, or availability.
9. SMS / Mobile Messaging Terms
Program Description
By opting in to receive SMS messages from TopCar, you agree to receive recurring messages regarding:
- competitions
- events
- account alerts
- verification updates
- promotions
- notifications
- platform announcements
Message Frequency
Message frequency varies based on your activity.

Standard carrier message and data rates may apply.
Carrier Disclaimer
Wireless carriers are not responsible for delayed or undelivered messages.
Consent
Providing your phone number constitutes your consent to receive SMS messages. Consent is not required as a condition of purchase.
Sharing of SMS Data
We do not sell, rent, or share your SMS consent information for marketing purposes.
Modifications
We may update these SMS terms from time to time.
10. Termination
We may suspend or terminate your account or access to the Services at any time if we believe you have violated these Terms or engaged in conduct harmful to the Services, other users, or the Company.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
We do not guarantee uninterrupted availability, accuracy, or reliability of the Services or of any user-submitted information.
12. Limitation of Liability
To the fullest extent permitted by law, TopCar Media LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services.
Our total liability shall not exceed the amount you paid to use the Services during the preceding twelve (12) months, if any.
13. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective upon posting unless otherwise stated. Continued use of the Services constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by the laws of the State of Michigan, without regard to its conflict of law principles.
